The "Dartmouth College Case" The decision of the Supreme Court of the United States, in the case of the Trustees of Dartmouth College vs. Woodward, is one of the most important cases which has ever been adjudicated in that court. It was argued at the December term of 1817, and the decision was rendered in the following February. The importance of the case is evidenced by the fact that it was argued by Daniel Webster, Jeremiah Mason, and William Wirt, on the part of the college, and by William Pinkney, Luther Martin, and Joseph Hopkinson, on the part of the State of New Hampshire. The case was brought before the court by the Trustees of Dartmouth College, to test the constitutionality of an act of the Legislature of New Hampshire, passed in 1816, which was designed to change the charter of the college, and to take away from the Trustees the power of appointing the President and Fellows, and to vest that power in the Legislature. The Trustees contended that the act was unconstitutional, because it impaired the obligation of a contract, in violation of the Constitution of the United States.
